DMCA policy

1. Our policy

Filexco respects intellectual property and expects its customers to do the same. We respond to notices of claimed copyright infringement that follow the US Digital Millennium Copyright Act (17 U.S.C. 512), and we close the accounts of repeat infringers in the circumstances the law describes.

Notices go to our designated agent (see Contact) or through the report form on this page. If you are not sure that something infringes, a lawyer can help; this page is not legal advice.

2. Sending a takedown notice

To report infringement, send a written notice that includes:

  • your physical or electronic signature, or that of a person allowed to act for the owner of the right;
  • a description of the copyrighted work you say is infringed;
  • a description of the material and where we can find it: the link, or for a vault file the object identifier (see "Encrypted vaults"). A general description is not enough for us to act on;
  • your name, postal address, telephone number and email address;
  • a statement that you believe in good faith that the use is not allowed by the owner, its agent or the law;
  • a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are allowed to act for the owner.

Use the report form on this page or email [email protected]. When a notice is complete we remove or disable access to the material promptly and tell the account holder, who may answer with a counter-notice. If a notice is incomplete we may ask for more information. Knowingly sending false information can make you liable for damages.

3. Counter-notices

If we removed your material and you believe that was a mistake or a misidentification, you can send a counter-notice using the form on this page (you need the reference and secret code from our email) or by email to [email protected]. It must include:

  • your physical or electronic signature;
  • a description of the material that was removed and where it was before it was removed;
  • a statement, under penalty of perjury, that you believe in good faith that it was removed because of a mistake or misidentification;
  • your name, postal address and telephone number, and a statement that you accept the jurisdiction of the federal court for the district of that address (or, if you are outside the United States, of any district where Filexco can be found) and that you will accept service of process from the person who sent the notice.

We send a complete counter-notice to the person who complained. Unless they tell us within 10 business days that they have started a court action, we restore the material no sooner than 10 and no later than 14 business days after we receive your counter-notice.

4. Repeat infringers

Users who are repeat infringers lose their accounts. While we review a report we may block the file, so that it cannot be downloaded or shared. When we accept a report, we delete the file and it counts as one strike against the account that owns it. Reports we decline, and files we delete without accepting a report, do not count. We count strikes over the last 12 months. An account that reaches three strikes is banned automatically. We may also close an account at once for serious or deliberate infringement.

5. Encrypted vaults

Files in an encrypted vault are encrypted in the user's browser before they reach us, so we cannot see their content or their names, and we cannot search a vault. For a notice about vault content, please give us the link or the object identifier of the file. We then disable access to exactly that object. If you cannot give us an identifier, we cannot find the material, and we will tell you so.

The same applies to counter-notices: we restore an object by its identifier.
